Wassiyyah's worldwide solution overview

Updated: Apr 9

Wassiyyah offers worldwide solutions with some limitations you should be aware of. Those limitations are not due to the capability of Wassiyyah, but reasons may not be limited to a lack of legal framework or restrictive laws on selling cross-border products and so on.

OVERVIEW

Worldwide offering means one or more countries of the world, but it does not mean that all world's countries. There are 250 countries or regions (approximately) globally. Wassiyyah has classified into three sections; the Muslim majority (50 approx), a Muslim minority (78 approx), and negligibly populated areas. Wassiyyah does not offer services to those negligibly small areas (see EXAMPLES) due to a lack of legal framework. However, Muslims living in those areas can still create estate plans but will get default estate plans, and Wassiyyah cannot confirm compliance due to an inadequate legal framework. For example, there is an Island with only 1,000 Muslims living on that Island. There is no legal framework or judiciary court that supports estate planning. It is not good in case a legal framework exists but does not have constitutional law that can support people's inheritance rights.

WASSIYYAH PRODUCTS

Following are some of the examples of our products on worldwide offering.

  • Islamic Wills comply with the majority of worldwide country laws.

  • Trust or Waqf is offered for specific countries.

  • Living Will (called Medical or healthcare directive) is offered worldwide. Wassiyyah offers jurisdiction (i.e., state, province, or territory) specific Living Will for USA, Canada, Australia, and part of Europe.

  • Power of Attorney for Property (or Financial) is offered for most worldwide countries. Wassiyyah offers jurisdiction (i.e., state, province, or territory) specific Living Will for USA, Canada, Australia, and part of Europe.

  • Power of Attorney for Healthcare (or Personal directive) is offered worldwide. Wassiyyah offers jurisdiction (i.e., state, province, or territory) specific Living Will for USA, Canada, Australia, and part of Europe.

  • Deed of Gift or Hibah, Islamic Inheritance certificate, Trust revocation agreement, Letter of Wishes, etc., can be used worldwide, but these estate plans comply with Shariah but may not be legally binding. However, creating these estate plans can improve your overall estate planning goal and outcome.

CAN NOT FIND JURISDICTION

There may be scenarios where you cannot find jurisdiction (i.e., state, province, or territory) when creating an estate plan.

If you live in a country where the population is low or a country that does not have jurisdiction (i.e., state, province, or territory), that will have a region, division, district, municipality, atolls, governorate, or prefecture (instead of jurisdiction). In this case, you would see the country name under jurisdiction (i.e., state, province, or territory), and that's why you do not find Jurisdiction to select in your dropdown menu when you create an estate plan.

If you live in Canada, USA, or Australia and cannot find the jurisdiction (i.e., state, province, or territory) in the dropdown selection, see more information HERE.
