Say no to 9 things for Islamic Will

Updated: Feb 8, 2023

Your Islamic Will either face one or more compliance issues or turns out to be nothing due to any misunderstandings. Your Will is valid, but you cannot prove it until it goes through the Probate process.

Do not slip with these 9 things

  1. Using Beneficiaries as witnesses are not allowed for most jurisdictions.

  2. You do not need to include specific details for estates in the Will unless you are creating Trust.

  3. The signing process is very critical for your Islamic Will to be legally and Islamically valid. Missing one or more requirements can turn your Will to be invalid.

  4. You can change the Islamic Will at any time as it is revocable. However, you must not correct the signed copy because it is not legal to do so. Either you can create a new one to revoke the old one or create a Codicil for the existing Will.

  5. You should not include a family tree but only close family members.

  6. Your Will is a very personal legal document, and you should secure it either in the bank deposit box or at home. Wherever you decide to keep, it should be free from fire and theft risk.

  7. Create the Islamic Will in the way it should be. Make the Islamic Will moderately simple. Do not include long paragraphs and many pages; those are unnecessary, but you have it because you feel that way.

  8. Creating Islamic Will with leaving empty spaces is not a good idea as someone can add the text for his or her benefits if the Will goes missing right before your death and you did not have the opportunity to update your Will.

  9. You should create Islamic Will without further delay as we do not know when we may become mentally incapable or die.
