How to make the Islamic Will to be legal?

Legal requirements for valid Will may differ from one country or jurisdiction to another. However, the minimum requirement to transform last Will documents to legal will are as follows

  1. Testator & Witnesses must meet at one location.

  2. Testator and Witnesses must be witnessed during the process of signing Will.

  3. Testator and Witnesses must be signed on every page of the Will at the bottom, and it should be in steps, page by page, i.e., all parties signing the first page and the second page and so on.

In any situation, your Will turns into legally invalid due to not following proper signing process, for example...

  1. You are not the sound mind, and someone is cheating on your behalf.

  2. You have created Will before the adult age as per country law.

  3. Testator signs the Will at his home and then bring to Witnesses for signing.

  4. Testator goes to the first witness for obtaining sign then goes to the second witness for signing the Will.

  5. Testator sends the Will via electronic or mail delivery to witnesses for signatures.

  6. All parties signed, and testator made corrections in the Will without witnessing.

  7. You have created Holographic Will. However, written Will is required by jurisdictional law.

  8. You have only two witnesses signed the Will, but there are three witnesses required as per regulations.

  9. You have only one executor of the Will, but there are two or more executors required for the Will.

  10. You have created Will and having two or more witnesses signed the Will to meet the legal requirement. However, Jurisdictional law requires the will to be notarized.

  11. You have created International Will, without witnessing the authorized person. In most country, the authorized person is a lawyer or member of bar associations as required by Internation Will convention, 1973.
